Party Structures and Neighbourly Matters

Party structures relates to party walls, party fence walls and party floors. Construction works to these elements is legislated by the Party Wall etc. Act 1996. The Act also covers legislative control relating to excavations within close proximity and lower than the foundations to neighbouring structures and also the construction of new walls to boundaries.

The Act is a powerful body of legislation and incorporates mechanisms to avoid parties protracting and disrupting matters. We fully embrace the purpose of the Act to ensure parties are treated in a fair and equitable manner without inappropriate delay or disruption which is ingrained in the spirit of the Act.

Schroeders Begg will guide parties through all the implications and requirements of the Act. In respect of developments / notifiable works, we will serve all appropriate notices in accordance with the Act and when a dispute is deemed to arise, we prepare an Award and associated documentation including a Schedule of Condition. When neighbouring owners have received notices, we will advise such parties of the implications and seek appointment as 'Adjoining Owner's Surveyor' in accordance with the Act.

As Chartered Building Surveyors, we are best placed to deal with appointments under the Act and to ensure our expertise is continually honed on interpretation of the Act due to an ever evolving industry, two of our specialists are members of a best practice body (The Pyramus and Thisbe Club).
 
Our appointments and involvement is in equal measurements for building owners (desirous of construction works resulting in notifiable works under the Act) and for adjoining owners affected by such works.
 
We also provide advice on other neighbourly aspects including licences for access and over-sailing such as for tower crane licences, high hedges and more litigious matters such as boundary disputes.
